Eyec Graphics provides design services with the option for revisions. While we strive for quality, no guarantees are made regarding results, effectiveness, or suitability of our designs for any particular purpose. Eyec Graphics shall not be liable for any direct, indirect, incidental, consequential, punitive, or special damages, including but not limited to loss of profits, business interruption, or data loss arising from the use of our designs, advice, or website content.

Eyec Graphics may use third-party printing, production, or fulfillment services to deliver physical products or media. We do not control these third-party providers, their quality, timelines, or delivery processes. Eyec Graphics is not liable for any errors, defects, delays, losses, or damages arising from the use of such third-party services. Use of our services constitutes acknowledgment and acceptance of this limitation of liability.

Distribution, Usage & Promotion

All designs and materials created by Eyec Graphics are licensed to clients for the agreed-upon use only. Clients may not copy, distribute, modify, edit, reprint, or allow third parties to alter or reproduce the designs in any way outside of that which is allowed explicitly by the applicable copyright and ownership laws without explicit written permission from Eyec Graphics. Unauthorized or illegal use or alteration constitutes a violation of this license and may result in legal action.

Eyec Graphics retains the right to use any designs, media, or materials created for clients at any point before, during, or after the provision of services for promotional purposes, including online and print media. This right applies regardless of whether the client uses the designs, modifies them, or makes changes after delivery. This right applies also to all iterations created before, during and after the final design is created and/or published, allowing Eyec Graphics to use alter designs, media, and materials at our own discretion. Eyec Graphics will take reasonable steps to protect client privacy and confidential information when using such materials for promotional purposes.

This website may include links to third-party websites, tools, or resources. Eyec Graphics has no control over these external entities and is not responsible or liable for their content, security, accuracy, or practices. Inclusion of any link does not constitute endorsement.

Prices & Policies

All prices displayed on this website are in Australian Dollars (AUD) and are subject to change without notice.

Eyec Graphics reserves the right to send quotes, invoices, and receipts in any currency, and reserve the right to decide on a reasonable exchange rate, informed by third-party exchange services or established financial information services. The exchange rate is to be established and agreed upon at the time of the initial quote. Eyec Graphics reserves the right to make alterations to the exchange rate at any point, provided mutual written agreement. Eyec Graphics is not responsible for any international currency exchange fee, and reserves the right to include these costs in all invoices.

Costs are to be agreed upon in writing prior to services being carried out. These prices are final without mutual written consent, and will appear in invoices and receipts as most recently agreed in writing.

Eyec Graphics reserves the right to modify, remove, or update any content, services, pricing, terms, or policies at any time without notice. We may also suspend or terminate services, accounts, or access at our sole discretion.

Should a disagreement arise, any price amount without a specified currency (e.g. AUD, NZD) shall be assumed to be Australian Dollars (AUD) and will be treated as such in regard to exchanges, invoices, receipts, quotes, and payments.

Jurisdiction

Eyec Graphics retains the right to pursue any legal remedies for unauthorized use of our content, designs, or intellectual property, including injunctive relief, damages, and recovery of legal costs.

This disclaimer, all services, and website use are governed by the laws of Victoria, Australia. Users agree to submit to the exclusive jurisdiction of the courts of Victoria for any disputes arising from this website or its content.

Use of Eyec Graphics’ designs, media, or services does not imply endorsement, sponsorship, or affiliation with any client, business, or third party.

Indemnification
Clients agree to indemnify, defend, and hold harmless Eyec Graphics, its owners, and affiliates from any claims, damages, liabilities, or legal expenses arising from the client’s use, modification, or distribution of designs or media.

Force Majeure
Eyec Graphics is not liable for delays, failures, or damages caused by events beyond our reasonable control, including natural disasters, power outages, internet failures, acts of government, or other unforeseen events.

Non-Transferable Rights
Any license, permission, or access granted by Eyec Graphics is personal and non-transferable unless explicitly authorized in writing.

Digital Security

Entire Agreement
This disclaimer, along with any signed agreements or contracts, constitutes the entire agreement between the client and Eyec Graphics and supersedes any prior communications or agreements.

Use of Client Testimonials or Projects
Eyec Graphics may reference client projects, logos, or testimonials for promotional purposes unless the client explicitly requests in writing that such use be withheld.

Eyec Graphics may use excerpts of client emails, messages, or correspondence as testimonials or promotional content, provided that personally identifiable information is removed or anonymized to protect client privacy. By submitting communications, clients acknowledge and agree to this use.

Refunds, Returns, & Cancellations

All services provided by Eyec Graphics are subject to the agreed-upon terms. Revisions are included as specified in the service agreement. Refunds, cancellations, or service suspensions are granted only at Eyec Graphics’ sole discretion and may be partial or denied depending on work completed. Clients acknowledge that once work has commenced, full or partial payments may be non-refundable. Eyec Graphics is not required to discount or reimburse any amount should a client decide to not use any or all of the provided designs.

Eyec Graphics reserves the right to cease all agreed upon services without prior notice, reimbursement, or any refund should a client violate any aspect of these terms, conditions, and disclaimers, and/or violation of any other agreement that has been established in writing and mutually agreed upon before, during, or after the commencement of works or request/fulfillment of payment.

Third-Party Storage and Sharing Disclaimer
Eyec Graphics may use third-party services, including cloud storage or file-sharing platforms (e.g., Google Drive), to store and deliver media or designs. We do not control these platforms and are not responsible for the privacy, security, integrity, or availability of files stored or transmitted via third-party services. Clients assume all risk associated with using such services, and are subject to their terms of usage separately from Eyec Graphics.

Eyec Graphics cannot guarantee that any or all files supplied to the client will be stored in any form after distribution to the client, and therefore is not responsible for redistributing any or all files after initial distribution  should the clients request it for any reason.

Dispute Resolution
Any disputes, disagreements, or claims arising from the use of Eyec Graphics’ services, designs, or website shall first be addressed in good faith through direct negotiation between the client and Eyec Graphics. If resolution cannot be reached, Eyec Graphics may, at its sole discretion, require mediation or arbitration before pursuing legal action.

Limitation of Updates / Version Control
Eyec Graphics is not responsible for any issues, errors, or inconsistencies that arise from clients using outdated, modified, or previously delivered versions of designs or media. Clients are responsible for ensuring they are using the most current and approved files.

​

Client Review Responsibility
Clients are responsible for thoroughly reviewing and approving all designs, drafts, or materials provided by Eyec Graphics. Failure to identify errors, omissions, or issues during the review process does not transfer liability to Eyec Graphics.

​

Intended Use Disclaimer
Designs and media created by Eyec Graphics are intended for the specific purpose agreed upon with the client. Eyec Graphics is not liable for any damages, losses, or legal issues resulting from use outside the intended purpose.

​

No Guarantee of Compatibility
Eyec Graphics makes no guarantees that designs, files, or media will be compatible with third-party software, platforms, hardware, or devices. Clients assume all risks associated with integration or usage in other systems.

​

Non-Solicitation of Collaborators
Clients may not directly solicit, hire, or engage any subcontractors, collaborators, or third-party contributors used by Eyec Graphics for any project, without prior written consent. Violation of this clause may result in legal action and recovery of damages.

​

Client Material Copyright Warranty
Clients warrant that any materials, content, logos, images, or media provided to Eyec Graphics for use in designs are owned by the client or that the client has obtained all necessary rights, licenses, or permissions for their use. Eyec Graphics is not responsible for verifying ownership or resolving claims of copyright infringement arising from client-provided materials. Clients agree to indemnify and hold Eyec Graphics harmless from any disputes, claims, or damages related to the use of such materials.
